www.rentoys.in ("Website") is an Internet based portal owned and operated by First Age Solutions Pvt. Ltd., a company incorporated under the laws of India, with its office at Bangalore, India. Use of the Website is offered to you conditioned on acceptance of all the terms, conditions and notices contained in these Terms, along with any amendments made by First Age Solutions at its sole discretion and posted on the Website.

Acceptance of Terms of Use

This 'User Agreement', which is intended to be a legally binding contract governs the subscriber of the Rentoys services and the website and contains the following:

A. Terms of Sale: this governs your purchase of the services and products

B. Website Terms of Use: this governs the access and use of the Website.

C. Rental Terms & Conditions: this governs the term and conditions that apply to the rental of the toy(s) from Rentoys.in.

D. Privacy Policy: this governs the use of your personal information we collect.

By using, visiting, or browsing our website, you agree that you are of legal age to enter into binding contracts, have read, understood and are bound by the User Agreement. If you do not want to be bound by this User Agreement, you should not use this Website or conduct any sale/purchase transaction.

References to "you", "User", “Member”, “Subscriber” shall mean the end user accessing the Website, its contents and using the Functionalities offered through the Website, "Service Providers" mean independent third party service providers or merchants, and "we", "us", "First Age" and "our" shall mean First Age Solutions Pvt. Ltd.

These Terms of Use affect the subscriber rights and the subscriber should read them carefully.

Changes to Terms of Use

We, reserve the right, from time to time, with or without notice to the subscriber, to change these Terms of Use in our sole and absolute discretion.

The most current version of these Terms of Use can be reviewed by clicking on the "Terms of Use" located at the bottom of the pages of the Rentoys Web site. The most current version of the Terms of Use will supersede all previous versions. The subscriber use of the Rentoys Web site or continued use of our service after changes are made means that the subscriber agree to be bound by such changes.

How Our Service Works

www.rentoys.in ("Website") is an Internet based portal owned and operated by First Age Solutions Pvt. Ltd., a company incorporated under the laws of India, with its office at Bangalore, India, to provide its members with access to a large variety of stimulating and unique toys for kids from newborn to 6 years old. Our carefully chosen toys are focused on promoting early age learning like fine motor, sensory, cognitive and emotional development. You can choose from subscription plan from a variety of subscription plans provided by us at varying price levels (details are available at www.rentoys.in website). Once you become member by selecting a plan and paying the required fees by different mode of payment provided by us, you can add toys to your wish list and submit to us. Post receiving the toys wish list, we process the request and deliver (if chosen) to member’s provided shipping address. You can request the next set of the toys, when your kid is done with playing (minimum to 15 days of exchange period) and we will deliver next set and pickup the previous ones.

Governing Law

These terms shall be governed by and constructed in accordance with the laws of India without reference to conflict of laws principles, and disputes arising in relation hereto shall be subject to the exclusive jurisdiction of the courts at Bangalore, India.

A. Terms of Sale: this governs your purchase of the services and products

• By submitting the membership registration form, you are expressly agreeing that we are permitted to bill you the required subscription fees (Refundable deposit, one time Registration Fee and Monthly Rental Charges), any applicable tax and any other charges that may be applicable in connection with the use of our service.
• The members will have to pay the charges through any of the mode of payment prescribed on the website.
• The members will have to pay the charges for the selected duration before or on the start of the service.
• Our members can opt to receive/return the toys at/from their shipping address by paying the delivery charges as advised on the website.
• Risk Free Trial – By default, every member of Rentoys gets 7 days of free trial. Any member who signs up for a monthly rental program can cancel their account within 7 days and receive a full refund. In order for the customer to receive their refund, their box of toys must be delivered back to our office within 7 days and they must inform us to deactivate their account. There are no exceptions. Any member who does not cancel their account and return their box within 7 days of their first shipment will be billed monthly for as long as they are a member. Members are only eligible for 1 risk free trial per account.
• Vacational, party packages are any existing members are not eligible for a risk free trial and no refund will be issued for the toys returned and accounts cancelled within the first 7 days.
• In case of membership termination, the refundable deposit (portion of the subscription fee) will be refunded back to the member after adjusting any dues at that point of time.
• The toys received in damage condition or missing pieces or the purchase of previously used toys or service level changes the subscriber request, will attract additional charges.
• Member is responsible for damage to toy(s) due to abuse, misuse, or negligence. Member agrees to pay the charges to repair toy(s) so damaged, and incurred shipping charges, if the damage is repairable. Toy(s) shall be returned to us in good condition and repair, wear from reasonable and proper use excepted. Upon return, member must certify that toy(s) is free from contamination. Member is responsible for loss or damage to toy(s) from theft, mysterious disappearance, fire or any other cause. In accepting liability for the safe keeping of all rented toy(s), member agrees to pay us the replacement cost (as determined by manufacturer’s current list price) of any such equipment which Customer is for any reason unable to return to us at the end of the rental period. Rental charges will continue beyond the specified rental term, at the monthly rental charge, until the toy(s) is returned or Customer reimburses Rentoys.in for the replacement cost of the toy(s).
• First Age is entitled to deduct any dues from the security deposit and the dues could be due to following but not limited to - damage to the toy(s) or in the event of non-payment of rental charges or other due amounts as may be intimated to you from time to time. In the event of any dues, you will be notified in advance and will have 7 days to make the payment. In case if we don’t receive the payment in defined time, the dues will be deducted from your refundable deposit. Under such circumstances, in order to continue the membership, you would be required to immediately pay such amount so that the refundable Deposit amount shall be always maintained. The right to make adjustments from the Security Deposit shall not preclude our rights to take such other suitable legal action that may otherwise be available to it, nor would it be taken to mean that the amount retained as Security Deposit indicates the upper limit of the amounts recoverable by us.

B. Website Terms of Use: this governs the access and use of the Website.

User Account, Password, and Security

The Website requires you to register as a User by creating an Account in order to use the services from the Website. You will receive a password and account designation upon completing the Website's registration process. You will be responsible for maintaining the confidentiality of the password and the account, and are fully responsible for all activities that occur under your password or account. You agree to (a) immediately notify First Age of any unauthorized use of your password or account or any other breach of security, and (b) ensure that you exit from your account at the end of each session. First Age Solutions cannot and will not be liable for any loss or damage arising from your failure to comply with the above.

The Member Conduct on the Rentoys.in Web Site

By accessing our Web site, you agree to use the Rentoys.in service, including all features associated therewith, the Website and its content in accordance with all applicable laws, rules and regulations. In addition, the subscriber agree not to upload, post, e-mail or otherwise send or transmit any material that contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment associated with our Web site.

User Obligations

You agree and undertake to use the Website only to post and upload material that is proper. By way of example, and not as a limitation, you agree and undertake that when using the Website, you will not:

• Defame, abuse, harass, stalk, threaten or otherwise violate the legal rights of others

• Notwithstanding anything to contrary, First Age's entire liability to you shall be the refund of one month rental charged from you for specific rental plan you have opted, under which the unlikely liability arises. Under no circumstance shall First Age be liable for any consequential, indirect or remote loss that you or your friends and family may suffer.

Intellectual Property Rights

• Unless otherwise indicated or anything contained to the contrary or any proprietary material owned by a third party and so expressly mentioned, First Age Solutions owns all Intellectual Property Rights to and into the trademarks "First Age" and "Rentoys", and the Website, including, without limitation, any and all rights, title and interest in and to copyright, related rights, patents, utility models, designs, know-how, trade secrets and inventions (patent pending), goodwill, source code, meta tags, databases, text, content, graphics, icons, and hyperlinks. You acknowledge and agree that you shall not use, reproduce or distribute any content from the Website belonging to First Age Solutions without obtaining authorization from First Age Solutions.

• Notwithstanding the foregoing, it is expressly clarified that you will solely be responsible for any content that you provide or upload when using any Service, including any text, data, information, images, photographs, music, sound, video or any other material which may be accessible through your post, or any other content that you upload, transmit or store when using the Website.

Disclaimers of Warranties and Limitations on Liability

First Age Solutions has endeavored to ensure that all the information on the Website is correct, but First Age neither warrants nor makes any representations regarding the quality, accuracy or completeness of any data, information, product or Service. In no event shall First Age be liable for any direct, indirect, punitive, incidental, special, consequential damages or any other damages. Neither shall First Age be responsible for the delay or inability to use the Website or related Functionalities, the provision of or failure to provide Functionalities, or for any information, software, products, Functionalities and related graphics obtained through the Website, or otherwise arising out of the use of the website, whether based on contract, tort, negligence, strict liability or otherwise. In no event shall First Age Solutions Pvt. Ltd, its shareholders, directors, officers, or employees be liable (jointly or severally) to this web site members for personal injury or any special, incidental, indirect or consequential damages of any kind, or any damages whatsoever resulting from loss of use, data or profits, business interruption or any other commercial damages or loss, whether or not advised of the possibility of damage, and on any theory of liability, arising out of or in connection with the use or performance of our Web site, its contents or our service, including any features associated therewith. In no event shall our total liability to the member for all damages for losses arising from the use or inability to use our Website, its contents or our service, including any features associated therewith exceed the amount of one month's rental fee on the member rental plan.

We are free to use any comments, information, ideas, concepts, reviews, or techniques or any other material contained in any communication you may send to us, including, without limitation, responses to questionnaires or through postings to our Web site without further compensation, acknowledgement or payment to you for any purpose whatsoever including, but not limited to, developing, manufacturing and marketing products and creating, modifying or improving the Web site or other Web sites. Furthermore, by posting any Content on our site, submitting Content to us, or in responding to questionnaires, you grant us a perpetual, non-exclusive, royalty-free irrevocable license and right to display, use, reproduce or modify the Content submitted in any media, software or technology of any kind now existing or developed in the future. Please note we do not accept unsolicited materials or ideas for use or publication, and is not responsible for the similarity of any of its content or programming in any media to materials or ideas transmitted to us.

C. Rental Terms & Conditions: this governs the term and conditions that apply to the rental of the toy(s) from Rentoys.in.

General

• The Website (www.Rentoys.in) provides you access to large variety of toys on rent are on ‘as is where basis’ is and we don’t have any role in their manufacture. Though, we use our criteria to select toys which are safe for kids, we are not providing any warranties or assurances on the safety, usability, condition or otherwise of the toys being rented out by it. Also, we highly recommend you to be fully aware of the warranties & representations and terms & conditions and instructions stated by the manufacturer of the toys.

• Toys manufacturer’s name is same as printed on the toys and might be repackaged by us after cleaning & sanitization of the toys.

• Though, the website categorize the toys based on age as guided by the manufacturers of the toy, You shall examine the toys to decide if the same is appropriate to be used by your kid safely and without any risk whatsoever, either to himself, or to those around him.

• The guardian supervision is must while child is playing with the toys and neither First Age or its Directors, employees will have an liability on the account of usage of the toys.

Delivery/Pickup of the Toys

The members can opt to receive/return the toys at their doorstep by paying a delivery charges as decided and mentioned by us on the website. We will call you before sending the delivery to confirm your availability to receive/return the toys. Once confirmed, the toys will be delivered by us.

Receiving of the Toys

You shall check the toys at the time of receiving to ensure that at time of renting, it is in good condition.

In the event that a toy is broken upon delivery, contact us within 24 hours of receiving the delivery, report the broken toy and it will be replaced for you at no cost. If you do not contact your local center office within 24 hours of delivery, we will assume the toy was damaged by you and you will be charged accordingly. In the event that a toy rented from us is broken by you, you will be required to purchase this toy from us at discounted price. The discount will defined completely by us.

Allocation, Delivery and Return of Rented Toys

We reserve the right to process new orders and otherwise allocate and ship Toys and other products among our subscribers in any manner that we, in our sole and absolute discretion, determine. In addition, we will, in our sole and absolute discretion, determine the quantity of toys we purchase of any brand or type, their location within our distribution network and the level of staffing and number of shipments to be processed at each distribution center. As a result of the operational practices described in this section, we may not always send the subscriber the top toy choices the subscriber has selected to receive.

Sanitization of the Toys

We give utmost care to your child safety. Once toys are back from customer, it goes 3 cycle of cleaning and sanitization process.

Automatic Membership Renewal and Billing Cycle

At the time of registration, the plan the subscriber choose will specify the membership committement level of the subscriber. We will bill the total payment including any applicable tax to the Payment Method the subscriber provide to us during registration (or to a different Payment Method if the subscriber change the subscriber account information). The subscriber membership will automatically renew for successive monthly subscriptions, without prior notice to the subscriber, unless and until the subscriber cancel the subscriber membership or we terminate it. The subscriber must cancel the subscriber membership before it renews each month in order to avoid billing of the next month's subscription fees to the subscriber Payment Method.

Refund/Cancellation

The subscriber may cancel the membership at any time. All toys that you did not purchase must be returned to avoid being charged the full value of the toys. WE DO NOT PROVIDE REFUNDS OR CREDITS FOR ANY PARTIAL-MONTHLY SUBSCRIPTION PERIOD OR FOR TOYS NOT PLAYED WITH. To cancel the membership, you will be required to call us and put request to 'Cancel My Account'. Upon cancellation, the subscriber will be given 7 days to return any outstanding rentals. Failure to return such rentals will result in the subscriber being billed for the retail cost of such items. We will send the subscriber a reminder email concerning unreturned toys prior to charging the subscriber Payment Method. We reserve the right to terminate the subscriber account for any or no reason.

Missing Pieces

In the event that a toy is returned to us with missing pieces, the subscriber will receive an email notice giving them 15 days to locate and return the missing piece. In the event that the piece is not located, the subscriber will be charged a missing pieces fee, if we will be able to find the spare piece with suppliers else you will be required to purchase the toys.

Gift Cards

All gift card purchases are non-refundable, but can be transferred to another user. Purchased gift cards will be emailed to the giver and, if specified the recipient. These Gift Subscriptions are sold on our website and are redeemable for our toy rental services only in the city/country our services are currently operational.

Right to Terminate

We reserve the right to terminate or restrict the subscriber use of our service, without notice, for any or no reason whatsoever. Limitations on Use The subscriber must be 18 years of age or older to subscribe to the Rentoys rental service. While individuals under the age of 18 may utilize the service, they may do so only with the involvement of a parent or legal guardian. Unless otherwise specified, the content on our Web site is for member’s personal and non-commercial use. Rentoys.in member may not download, modify, copy, distribute, transmit, display, perform, reproduce, duplicate, publish, license, create derivative works from, or offer for sale any information contained on, or obtained from, the Web site without our express written consent.

If you or First Age Solutions terminates your use of the Website, First Age Solutions may delete any content or other materials relating to your use of the Website and First Age Solutions will have no liability to you or any third party for doing so.

Buying Toys

Rentoys.in sells certain (New & Used) toys that are part of the rental program. Members receive 5-15% discounts on toy purchases, no limit. To make a purchase, when available, You can write to your center contact email id and they would guide you with the further steps. Applicable taxes and shipping charges (if any) will be added to the purchase price, but there are no other additional charges.

Toy Care Policy

Treating our toys gently and keeping them in the best possible shape is an essential part of the Rentoys Toy Rental Program. Members must adhere to the following Toy Care Policies:

• Members are to wipe down any toys with visible debris ie. food, dirt, etc. before shipping the toys back to Rentoys.
• Unless a toy is a bath-time toy, Rentoys toys are not for in-water use.
• Unless a toy is a high-chair toy, please do not allow the subscriber children to handle the toys with food.
• Rentoys toys are not for use in mud, sand or dirt.

We give utmost care to your child safety and committed to cleaning and fully sanitizing each toy before it is shipped. Any toy that is returned heavily soiled ie. smeared with jelly, ketchup, etc. or corroded with sand or dirt may result in any additional cleaning fee may be applied per soiled toy. If we are unable to get any toy returned by a member clean enough to remain in the program, the toy will be shipped back to the customer and the customer will be billed for the discounted cost of the toy plus the cost of shipping.

D. Privacy - Collection and Use of Information

We keep track of the subscriber interactions with us, including but not limited to the subscriber site activity, toy selections, payment history and correspondence. We use this information for such purposes as personalizing the site to better reflect particular interests, helping us quickly and efficiently respond to inquiries and requests and otherwise enhancing our service offering for our customers. We may also disclose and otherwise use, on an anonymous basis, toy ratings, consumption habits, commentary, reviews and other non-personal information about customers. When the subscriber register or re-register at our Web site, we ask the subscriber to supply us with personal information so that we can provide, enhance and personalize our services and marketing efforts. For similar reasons, we may supplement the personal information the subscriber provide with publicly available information about the subscriber. We use this personal information to process the subscriber registration, the subscriber orders and the subscriber payments, and to communicate with the subscriber on these and other topics. We also use the subscriber e-mail address to send the subscriber newsletters, as well as messages about ˜First Age™" promotional announcements and consumer surveys. Occasionally, we may send these materials to the subscriber via postal mail, using the shipping address provided. Our Shipments that contain the toys the subscriber ordered may also contain promotional items or advertisements. Please note that the subscriber cannot unsubscribe from certain correspondence from us, including messages relating to the subscriber account transactions.

Member Age Requirement

Limitations on Use The subscriber must be 18 years of age or older to subscribe to the Rentoys rental service. Unless otherwise specified, the content on our Web site is for member’s personal and non-commercial use.

Viewing and Updating Your Information on the Website

You are responsible for updating and maintaining the truth and accuracy of the personal information you provide to us relating to your account. If you want to update your contact information, you should do so by on the Website by clicking "My Account", select what type of change you wish to make and follow the prompts.
